Interpretation

The words of which the initial letter is capitalized have meanings defined under the conditions specified in the below ‘Definitions’ section. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

  • CEE (or “Company”, “the Company”, “We”, “Us” or “Our”) refers to Customized Early Education, Inc.

  • You or User(s) means the individual(s) accessing the Service, or the institution, company, business, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

  • Website or Site refers to the following site: www.customizedearlyeducation.com and all affiliated pages.

  • Program refers to a school, program, center, or other affiliated entity that books Professionals through our Website. A Program is referred to as the “Purchaser” in our Early Childhood Program Agreement, and Programs are included within the meaning of Affiliates.

The Cookie Policy discloses and outlines our use of cookies on the Website. The Privacy Policy informs users of how our Website collects, uses, shares, and protects personal information. Terms of Use

Please read our Terms of Use (“Terms”) which are separately available on our Website, and which also govern your use of CEE bookings and services. These Terms explain the agreements made between us and users and outline the rights and responsibilities of both Parties, establish the rules of engagement for using our Website, include and explain disclaimers and limitations of liability which may impact a user’s legal rights, and specify the jurisdiction and governing law applicable to any disputes arising from the use of our Website.

Our Terms may be updated from time to time to reflect changes in law, usage, and company policy. Users will be informed of these changes here on this Page and are encouraged to review our Policies periodically.

Program Disclaimer to Affiliates

CEE operates solely as a network that trains and connects substitute early childhood educators (“Professionals”) with schools, programs, and other affiliated entities (“Affiliates”). CEE is not the employer of the Professionals and does not direct, supervise, schedule, set the pay of, or otherwise control the Professionals or the manner in which they perform their work. Affiliates are solely responsible for directing, supervising, scheduling, and, where applicable, paying the Professionals they engage. While we ensure that all Professionals undergo comprehensive and ongoing training, CEE shall not be held accountable for any damages, harm, loss, or other issues that may arise in connection with any Professional whom an Affiliate books or engages. By utilizing our services, Affiliates acknowledge and agree to the following terms:

  1. No Liability: CEE is not responsible or liable for any acts, errors, or omissions of the Professionals. This includes but is not limited to any physical, emotional, or psychological harm, or any other form of loss or damage that may occur while the Professionals are performing their duties or are otherwise engaged by an Affiliate. Because CEE does not employ, direct, supervise, schedule, or control the Professionals, the Affiliate that engages a Professional bears sole responsibility for that Professional’s conduct.

  2. Assumption of Risk: Affiliates assume full responsibility for any risks associated with the use of our Professionals. This includes any and all potential claims, liabilities, or damages that may arise from the Professionals’ actions.

Program Disclaimer to Professionals

CEE does not guarantee that Professionals will receive job opportunities or assignments through our online booking services or calendar. The availability of assignments is subject to the demand and discretion of the Affiliates that utilize our services.

Third-Party Sharing Disclaimer

We do not currently but may, in the future, share personal data collected from users with third parties. This may include, but is not limited to, sharing information with marketing companies, advertisers, or data brokers. We ensure that any such sharing is conducted in compliance with applicable laws and regulations, and users have the right to opt out of this data-sharing arrangement by contacting us at the email provided below. Our data-sharing purposes and limitations are outlined in further detail in our Privacy Policy and Cookie Policy.

In this case, our Website may contain links to advertisements or external websites that are not provided, maintained by, or in any way affiliated with the Company. Payment Processing Disclaimer

Currently, We utilize a third-party payment processor for processing payments for transactions related to our Services through our Website. By agreeing to the Terms of Use, you are also agreeing to Stripe’s Terms of Service and Privacy Policy. We do not store or have access to your full payment and financial details. Our third-party payment processor is a separate service provider, and we have no control over and assume no responsibility for the security, accuracy, or handling of your payment information by that processor.

Our Website operates on a “book now, pay after service” basis. When a Program (as defined above and in our Terms of Use and Early Childhood Program Agreement) books a Professional, the Program’s card or other payment method will be securely saved through our third-party payment processor. CEE will not charge the Program at the time of booking. Instead, CEE may later charge the saved payment method automatically for completed bookings and for any other amounts due under the Early Childhood Program Agreement. The total amount charged may vary depending on the number of bookings completed and on the application of our cancellation terms. Bookings cancelled by CEE or the Professional, and bookings a Program cancels on time in accordance with our Early Childhood Program Agreement, will not be charged; however, bookings that are not cancelled by the applicable deadline may remain due and payable even if no hours are ultimately worked, as set out in that Agreement. Charges are processed on a weekly basis rather than on a 30-45 day invoice cycle.

Failed payments, refunds, credits, disputes, and cancellations will be handled in accordance with our Terms of Use, Early Childhood Program Agreement, and Refund and Cancelation Policy. By saving a payment method and using our booking services, the Program affirmatively authorizes CEE to securely save its payment method through its third-party payment processor and to charge that payment method after completion of services for all completed bookings, in accordance with CEE’s Terms of Use, Early Childhood Program Agreement, and Refund and Cancelation Policy. Programs must affirmatively agree to these terms before a payment method is saved.

Data Collection Disclaimer

We collect certain user data to enhance our services and provide accurate bookings. However, we do not bear responsibility for any loss, damage, or inconvenience that may occur due to reliance on or usage of this data. We strongly encourage users to verify the data before utilizing it for personal or business objectives.

Intellectual Property Disclaimer

All logos, trademarks, patents, copyrights, or their respective applications belong solely to CEE and may not be used, published, or distributed without the explicit, written agreement of Us.

No Guarantee Disclaimer

CEE does not guarantee that any services provided on or through the Website will be uninterrupted or error-free. We reserve the right to revise the services and to suspend or deny access to them at any time without notice.
